SCOPE OF THE GENERAL CONDITIONS OF SALE
These General Conditions of Sale apply to all transactions on waww.fr (the Site) concerning new products sold by WAWW. For the Conditions of Sale and Purchase of 2nd Life second-hand items, Click here. The fact of carrying out a transaction on the Site implies full and unreserved acceptance of these General Conditions of Sale. Any document other than these General Conditions of Sale and in particular catalogs, prospectuses, advertisements, notices, is only informative and indicative, not contractual. WAWW reserves the right to modify these General Conditions of Sale at any time. In this case, the applicable version will be the one accepted by the user when ordering.
The products governed by these General Conditions of Sale are those which appear on the Site. Each Product offered for sale on the Site is offered within the limits of available stocks, and the essential characteristics of the Products are described and presented with the greatest possible accuracy, in accordance with legal requirements. Minor differences between the Products delivered and those represented on the Site may exist, mainly for Handicrafts for which the homogeneity of production cannot be fully guaranteed.
The price of the Products is indicated in Euros and inclusive of all taxes, excluding delivery costs. The amount of the delivery costs will be specified before validation of the order. Prices inclusive of VAT are understood to include VAT for products delivered to the European Union. Items subject to VAT are subject to French VAT. WAWW reserves the right to modify its selling prices at any time, it being specified that the price accepted by the buyer when ordering is firm and final.
WAWW accepts payments by Visa, MasterCard and American Express credit cards, using the services of its payment provider Stripe. WAWW also accepts payments by PayPal.
The products are delivered by our professional delivery partners. The buyer is required to check the condition of the packaging and the Products upon delivery and to make any reservations and complaints that may prove necessary. These reservations or complaints must be formulated in writing on the carrier's slip, dated and signed. The buyer must inform WAWW of this within a maximum of 72 hours from delivery, by email to firstname.lastname@example.org.
By signing the delivery slip or the transport receipt without making any reservations, the buyer acknowledges that his package has not been damaged during transport. In the event of a dispute, the original packaging must be kept until the dispute is resolved. These provisions apply without prejudice to the provisions of Article 8 hereof relating to the buyer's right of withdrawal.
Delivery times are specified on the Site during the purchase. If the buyer finds that the expected delivery date has been exceeded, he will be able to cancel his order by sending an email to email@example.com giving the references of his order. In this case, WAWW will refund the amount of the order within 30 days of receipt of the cancellation request. In the case of delivery of the order after the cancellation request, the buyer agrees to refuse the package to the carrier or to return it.
RIGHT TO RETRACT
The buyer has a right of withdrawal which allows him to cancel his order and return the ordered Products to WAWW within 14 days from the day after receipt of his order. Prior to returning the Products, the buyer will indicate his intention to exercise his right of withdrawal to WAWW by e-mail to firstname.lastname@example.org indicating the order references. The return will be at the expense and risk of the buyer. The Products will be returned packaged in their original packaging, in a condition allowing them to be put back on sale. Products damaged in any way, soiled and / or incomplete will not be taken back or reimbursed. The packaging and delivery costs paid by the buyer at the time of his order remain at his expense, only the selling price of the product will be refunded.
The buyer benefits from the legal guarantees conferred on him by the Consumer Code and the Civil Code. The legal guarantee of conformity only applies to the essential characteristics of the products. The photographs of the products presented on the site are as faithful as possible but cannot ensure a perfect similarity with the products offered, in particular with regard to the colors.
LIABILITY AND LITIGATION
WAWW will not incur any liability for the total or partial non-fulfillment of an order in the event of force majeure, fault of the buyer, payment incident or the unforeseeable and insurmountable fact of a third party. Likewise, WAWW cannot be held liable for any damage inherent in the use of the Internet such as, in particular, a breakdown in service, loss of data, external intrusion or the presence of viruses. In the event of non-compliance by the buyer with the obligations subscribed to under these General Conditions of Sale, communication of inaccurate information, any payment incident and / or fraudulent use of a payment card, WAWW will reserves the right to close its account and cancel any order in progress, without prejudice to any claim for damages. WAWW also reserves the right to refuse any order from a buyer with whom there is such a dispute. In the event of a dispute, the buyer will send a complaint to WAWW, by email to the address email@example.com or by mail to 56 rue de l’université, 75007 Paris, in order to seek an amicable solution.
