SCOPE OF THE GENERAL CONDITIONS OF USE 2V

These General Conditions of Use apply to all transactions on the 2v.waww.fr site (the 2V Site) concerning second-hand items. For the Conditions of Sale of new products sold by WAWW, Click here. Carrying out a transaction on the 2V Site implies full and unreserved acceptance of these 2V General Conditions of Use. Any document other than these 2V General Conditions of Use and in particular catalogs, prospectuses, advertisements, notices, is only informative and indicative, not contractual. WAWW reserves the right to modify these 2V General Conditions of Use at any time. In this case, the applicable version will be the one accepted by the user during their transaction.

SERVICES

The 2V Site is a site for connecting sellers and buyers of used items. Buying and selling is between buyer and seller. Under no circumstances does WAWW participate in the purchase and sale transaction. WAWW has no responsibility and does not grant any warranty with regard to the products delivered to each other by users, their characteristics and their conformity with the seller's announcement, nor with regard to transport and problems resulting from said transport.

WAWW offers the following free services to facilitate the transaction:

- Hosting of sellers' announcements.

- Messaging between the seller and the buyer.

- Use by sellers of preferential shipping rates negotiated by WAWW.

- Management of potential disputes.

In addition, WAWW manages the escrow of payment during the transaction to guarantee the seller the availability of the amount and guarantee the buyer receipt and acceptance of the items before the amount is transferred to the seller. For this service, the buyer pays € 1 per purchase and the seller pays 7% of the price of the item sold. WAWW pays part of the amount received for this service to its payment provider Stripe.

WAWW 2V MESSAGING

WAWW recommends the use of WAWW 2V messaging for all communication between buyer and seller. In the event of a dispute, WAWW provides the buyer and seller with a copy of the messages exchanged.

OBLIGATIONS OF USERS

Users undertake to protect the personal data of users communicated to them during a transaction, to keep them strictly confidential and to comply with the applicable legislation in this area.

Professional users are required to check the "Professional" box in their profile.

ADVERTISEMENT

Ads should describe the items as precisely as possible. Defects must be mentioned. WAWW reserves the right to refuse to publish an advertisement on the 2V Site without providing any justification. WAWW reserves the right to modify photos uploaded by sellers only for the purpose of maintaining the aesthetics of the home page of the 2V Site. Changes made to photos by WAWW do not affect the item or its color.

CONFIRMATION OF PURCHASE AND AVAILABILITY OF THE ITEM

Clicking the Buy button and filling in the details of a credit card does not guarantee purchase of the item. In order for the purchase to take place, the seller must confirm the availability of the item and the seller must either ship the item or meet with the buyer to exchange the item. WAWW is not responsible for any actions or lack of action by the seller, even if such actions result in the cancellation of the purchase. In the event of cancellation of the purchase due to seller's actions or lack of actions, WAWW guarantees the buyer a full refund of the sequestered amount.

PRICE

The price of each item is established by the seller. The price may include VAT if the item is new. Any additional taxes are at the buyer's expense. Only the seller can generate an invoice for the item sold. WAWW cannot be held responsible if the seller does not generate the invoice. The seller can change the price of the item at any time. The price to be paid by the buyer is the price displayed when the buyer clicks the Buy button.

PURCHASE AND PAYMENT PROCESS

An amount corresponding to the price of the item and the transport, if applicable, is immediately blocked on the buyer's credit card. The seller is notified of the purchase request. The seller can accept or decline the purchase request. If the seller refuses the purchase request or if the seller does nothing for 3 days, the purchase request is canceled. If the seller accepts the purchase request, the amount blocked on the buyer's credit card is debited and then sequestered at WAWW. The buyer has 14 days to accept or reject the item. If the buyer accepts the item, the amount, less WAWW fees, is paid into the seller's bank account and the transaction is closed. If the buyer refuses the item, the amount remains sequestered by WAWW and litigation is initiated. If the buyer does nothing, the item is automatically accepted after 14 days and the amount, less the WAWW fee, is paid into the seller's bank account

RIGHT TO RETRACT

The buyer has a right of withdrawal which allows him to cancel his order and return the item within 14 days from the day after receipt of his order only if the seller is a professional. Professional sellers are clearly indicated on the 2V Site. The right of withdrawal applies between the buyer and the seller. Prior to returning the item, the buyer will indicate his intention to exercise his right of withdrawal to the seller. The terms of the return of the item and the reimbursement of the buyer are agreed directly between the buyer and the seller.

LITIGATION BETWEEN USERS

A dispute is created when a buyer refuses an item for any reason. Users are encouraged to resolve any dispute amicably through WAWW 2V messaging. If unable to find an amicable solution, WAWW acts as a mediator and offers solutions. If a buyer refuses all the solutions offered by WAWW and the seller is a professional, the buyer can refer to the seller's mediator.

LIABILITY OF WAWW AND LITIGATION AGAINST WAWW

WAWW will not incur any liability for the total or partial non-performance of a purchase or sale in the event of force majeure, user fault, payment incident or the unforeseeable and insurmountable fact of a third. Likewise, WAWW cannot be held liable for any damage inherent in the use of the Internet such as, in particular, a breakdown in service, loss of data, external intrusion or the presence of viruses. In the event of non-compliance by the user with the obligations under the terms of these 2V General Conditions of Use, communication of inaccurate information, any payment incident and / or fraudulent use of a payment card, WAWW reserves the right to close its account and cancel any pending transaction, without prejudice to any claim for damages. In the event of a dispute, the user will send a complaint to WAWW, by email to info@waww.fr or by mail to 56 rue de l'Université, 75007 Paris, in order to seek an amicable solution. Otherwise, the French courts will be competent, and French law will apply.
